Terms & Conditions

These are the terms and conditions for using the Hawkridge Distillers and Just Gin Club website (the “Site”). This Site is maintained and operated by Hawkridge Distillers (the “Company”). The company is registered in England and Wales under number 11333421.

If you are accessing, browsing or using this Site, you accept that you have read and agreed to be bound by the below Terms of Use (“Terms”). Hawkridge Distillers reserves the right to amend these Terms at any time by updating this document. The company will not change these Terms in relation to orders which have been placed and confirmed by the company before any amendments are made. By agreeing to these Terms you also agree to our Site Privacy Policy.

By engaging with any part of the site, you accept, without limitation the Terms herein. Should you not agree with all of the Terms set out below, you may not use any part of the site. The company reserves the right to amend pricing at any time.

We reserve the right to amend the available services and products on our Site and to amend any aspect of the Site without notice.  We will not be liable in any way to you or to any other third party for making such amendments. Your use of the Site will constitute your acceptance of any such amendments.

Site Usage

You are permitted to only use the Site for your personal use and in accordance with the following Terms. You are responsible for your own communications and posting of information and you are responsible for the consequences of your communications on the Site. You may not copy, change, or distribute any information from this Site without the express written permission of Hawkridge Distillers Ltd.

By using the Site, all Members agree not to use the Site for the following purposes:

• Communicating or transmitting any material that infringes on intellectual property or privacy right of another person or entity
• Engaging behaviour that would constitute a criminal offense, give rise to civil liability or otherwise violate any law or regulation
• Communicating or transmitting any false information, or postings which are discriminatory, defamatory, degrading, abusive, derogatory, hateful, false, misleading, inaccurate, fraudulent, malicious, harassing, threatening, offensive, racist, obscene, indecent, vulgar or pornographic.

Registration and Passwords

To be able to access certain areas of the Site, you may need to provide specific information about yourself. Any such information must be truthful. You must not use any aliases or other methods to hide your identity. You are responsible for the security of your passwords and access information.  You will be solely responsible and liable for any use and unauthorized use under your access codes or passwords. We reserve the right to suspend or terminate your access to the site at any time without notice.

Your personal information​

We take our commitment to protecting your privacy and any information we receive from you very seriously.   We engage reasonable management and technical practices with the aim of protecting the security, confidentiality and integrity of your data which is stored on our systems.

We will not sell, lease or distribute your personal information to any third party without your permission or unless we are required to do so by law. Please review our privacy policy for further information.

Just Gin Club Membership

Our Site may only be used by registered users who are 18 years and older and users who are not subject to suspension or removal by Hawkridge Distillers. We reserve the right to revoke your membership at any time and for any reason including as a result of a violation of these Terms or our Privacy Policy.

In the instance that we revoke your membership, your current orders which we have acknowledged will remain unaffected unless we revoke due to your breach of these Terms or the Privacy Policy or any other Site rules, in which instance we reserve the right to terminate all existing orders without any obligation to refund you. If we revoke your subscription membership, you will refunded subscription fees on a pro rata basis. Where prohibited by the law, membership is void.

Just Gin Club Membership Contracts

Just Gin Club  Membership Packages (“Memberships”) are confirmed by clicking on the Membership you wish to purchase. You will then be guided by on screen prompts. You can review, correct and confirm any mistakes in your order up until you submit your order to us by clicking the “Confirm Order” or equivalent button in the club checkout page.

Your order constitutes an offer to Hawkridge Distillers to buy a Membership to our Just Gin club. All orders are subject to acceptance by Hawkridge Distillers. The company is not obliged to accept your order and reserves the right to decline any order. Where the company accepts your order, it will confirm acceptance of the order by sending to you an email that it has recognised your order.

By purchasing a Just Gin Club membership you agree that your Membership carries a recurring payment. You also accept responsibility for all recurring charges prior to cancellation. Your membership subscription to Just Gin Club will be automatically extended for successive agreed periods, at the subscription rate agreed at the time of your order. Your selected payment method will be charged between the 20^th and the 24th of every calendar month. Membership cancellations must be exercised prior to the 20^th of the month to avoid any charges for the current month.

You may cancel your subscription to the Just Gin Club at any time by emailing us at members@hawkridgedistillers.com.  We will acknowledge your cancellation on a timely basis with confirmation of your cancellation. Even in the event of your cancellation, you will be able to use all features of your subscription until the end of the month.

The price of your monthly membership includes VAT except for members located in the Channel Islands.

Discount Codes

If you have received a promotional discount code, this must be input during checkout. We only permit that one code be used at checkout. No codes can be used in conjunction with any other offer. Discount codes cannot be added retrospectively. Offers are non transferable and non redeemable for cash or credit.

We reserve the right to cancel, amend or withdraw discount codes at any time. We reserve the right to reject discount codes if we suspect involvement in any fraudulent activity.

Your membership rights & cancellation

You may cancel your month-to-month Membership before the 20th of each month either by managing your subscription through the online function provided or by contacting Hawkridge Distillers by email (members@hawkridgedistillers.com). Hawkridge Distillers will not refund monies paid for a month in which the Membership bottle has already been dispatched. Members who have subscribed to the Just Gin Club with a discount code may not cancel and re-subscribe using the same or another discount code for membership within a 24 month period.

Gift Memberships cannot be cancelled.

In the event that you receive a damaged or broken bottle, you may contact us to declare your damaged or broken bottle. Refund requests must be communicated within 48 hours of receiving your damaged or broken bottle. Hawkridge Distillers will then send you a replacement bottle of the same craft gin. Hawkridge Distillers will not refund damaged or broken bottles. Hawkridge Distillers also reserves the right to dispute the claim to reception of a damaged or broken bottle.

The company’s logistics partners normally alert Hawkridge Distillers of any a broken bottle before it is delivered. In this eventuality, Hawkridge Distillers will send you a new bottle as quickly as possible.

Proprietary Rights

You agree that the content available on the Site is the property of Hawkridge Distillers or our partners and is protected by, trademark, copyright or other proprietary rights / laws. All of our Site’s content is the property and copyright of Hawkridge Distillers. All rights reserved. Except as expressly set forth in these Terms, no license is granted to you and no rights are conveyed by virtue of accessing or using the Site.

Disclaimers

Hawkridge Distillers is not responsible if you are not able to gain access the Site in part or entirely because your internet connection, the performance of your ISP or any other event outside Hawkridge Distiller’s control. If you cannot access the Site partially or at all because any of these reasons, Hawkridge Distillers will not refund monies paid by you or offer any compensation.

Severability

If any part of these Terms shall be held or declared to be invalid or unenforceable for any reason by any court of competent jurisdiction, such provision shall be ineffective but shall not affect any other part of these Terms.

Governing Law

The operation of our site and Contracts for the purchase of Goods through our site are governed by English law. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.

VAT and Delivery costs for members in Northern Ireland, The Channel Islands and other remote areas of the UK.

Our clients in the Channel Islands, do not pay VAT on their orders.
